Terms and Conditions

These Terms of Service ("Terms") are an agreement between you and OpenBeam, LLC ("OpenBeam", "we", "us") and govern your use of openbeam.world, OpenBeam Cloud, the OpenBeam desktop software, the OpenBeam MCP server and related services (the "Services"). By using the Services, you agree to these Terms and to our Privacy Policy. If you use the Services for an organization, you agree on its behalf and confirm you have authority to do so.
The short version
- You own your models, scripts, recordings, telemetry and datasets, and you can use them for anything lawful, including commercial models.
- Simulations are approximations. Do not rely on them alone for safety decisions.
- You are responsible for what your account and your agents do, and the usage they generate.
- You can cancel at any time and export your data.

1. The Services
OpenBeam Cloud runs soft-body physics simulations on our infrastructure, streams them to your browser, and lets you record, replay and export video and telemetry from your runs. Features vary by plan as described on our pricing page.
2. Accounts
You must be at least 18, or the age of majority where you live, to use the Services. You agree to give accurate information, keep your credentials and API keys secure, and tell us promptly about any unauthorized use. You are responsible for all activity under your account. We approve beta accounts at our discretion.
3. Free beta
Beta features may change, be limited or become unavailable, and are provided as is. Each new account receives 3 free simulation hours; after that, a payment method is required. We may end the free beta with reasonable notice.
4. Plans, billing and usage
- Billing start. Billing opens October 26, 2026. Until then, every account runs on the free beta.
- Fees. Fees are set out on our pricing page or in your order form. Subscriptions are billed monthly in advance. Usage past your included hours is metered and billed in arrears.
- How hours are counted. Simulation hours are counted per stream while a solver is attached, so five streams for one hour use five hours. Queued and idle time is not billed. Unused included hours do not roll over.
- Spend caps. You can set spend alerts and caps. We will not charge metered usage beyond a cap you have set; new runs pause until you raise it.
- Founding price. The first 100 Personal subscribers who subscribe by November 1, 2026 keep the $30 monthly price for 12 months from the start of their subscription, as long as it stays active.
- Renewal and cancellation. Subscriptions renew automatically until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period. Fees already paid are not refundable except where the law requires.
- Price changes. We will give at least 30 days' notice of price changes. They will not affect a billing period already paid or a founding price term.
- Invoices. Teams invoices are due within 30 days unless your order form says otherwise.
- Non-payment. If a payment fails or an invoice is overdue, we may suspend paid features after giving you notice.
- Taxes. Fees exclude taxes, which you are responsible for.
5. Your content
You own it. As between you and OpenBeam, you own everything you upload to the Services and everything your runs produce, including recordings, telemetry, logs and datasets ("Customer Content"). You may use Customer Content for any lawful purpose, including commercial products and training commercial models.
Our limited license. You give us a non-exclusive, worldwide license to host, process, transmit, render and display Customer Content only as needed to provide, secure and support the Services for you. This license ends when you delete the content, except for copies in backups, which are deleted on the schedule in our Privacy Policy.
What we will not do. We do not claim ownership of Customer Content, and we will not use it to train AI models or make it public without your explicit written permission.
Your responsibility. You confirm you have the rights needed to upload Customer Content, including any third-party models, assets or scripts, and that it does not infringe anyone's rights or violate the law.
6. Our property
The Services, including the solver, engine, software, documentation, website and the OpenBeam name and logo, are owned by OpenBeam or its licensors. These Terms do not give you any rights to them except those expressly stated. If you send us feedback or suggestions, we may use them without any obligation to you.
7. Desktop software
If your plan includes OpenBeam desktop software, we grant you a limited, non-exclusive, non-transferable license to install and use it on devices used by your authorized users, for your internal purposes, while your subscription is active. Open source components are licensed under their own terms.
8. Acceptable use
You agree not to:
- Use the Services in violation of any law, or to infringe or misappropriate anyone's rights.
- Upload malware or code designed to harm, probe or escape the Services or other customers' workloads.
- Attack, overload or interfere with our infrastructure, or test its security without our written permission.
- Circumvent metering, spend caps, rate limits, seat limits or access controls, or share accounts beyond the seats you pay for.
- Reverse engineer, decompile or copy the Services, except where the law expressly permits.
- Resell the Services or offer them to third parties as a hosted service without a written agreement with us.
- Use the Services to design weapons intended to harm people, or in violation of export control or sanctions laws.
- Present simulated outputs as real-world test results or certified measurements.
9. AI agents and MCP
When you connect an AI agent or other automated tool to the Services, it acts on your behalf. You are responsible for its actions and for the usage it generates, which is billed to your account. We recommend setting spend caps for automated workloads. We may rate limit automated access to protect the Services.
10. Simulation results
Simulations are approximations of physical behavior. Their results depend on the models, parameters and settings used and may differ from the real world. The Services are not a substitute for physical testing, engineering judgment, regulatory certification or safety validation. You are solely responsible for how you use simulation results, and you must not rely on them alone for decisions that affect human safety, such as vehicle crashworthiness, robot safety or structural integrity, without independent validation.
11. Paid pilots and order forms
Paid pilots and Enterprise subscriptions may be governed by an order form or statement of work. If it conflicts with these Terms, the order form controls for that engagement.
12. Confidentiality
We treat Customer Content and any non-public information you share with us as confidential, and use it only to provide the Services to you. If you receive non-public information about OpenBeam, such as unreleased features or pricing, you agree to keep it confidential.
13. Suspension and termination
You can close your account at any time. We may suspend or terminate your access if you materially breach these Terms, fail to pay, create a risk to the Services or other users, or if the law requires it. We will give you notice where reasonable. After your account closes, you have 30 days to export your Customer Content, after which it is deleted as described in our Privacy Policy. Sections 5, 6, 10 and 14 through 19 survive termination.
14. Disclaimers
The Services are provided "as is" and "as available". To the fullest extent permitted by law, OpenBeam disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Services will be uninterrupted or error free, or that simulation results will match real-world behavior.
15. Limitation of liability
To the fullest extent permitted by law, OpenBeam will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from or related to the Services. OpenBeam's total liability for all claims related to the Services is limited to the greater of the amounts you paid us in the 12 months before the claim or 100 US dollars.
Some jurisdictions do not allow these limits, so they may not apply to you in full.
16. Indemnity
You will defend and indemnify OpenBeam against third-party claims arising from your Customer Content, your use of the Services in violation of these Terms, or your violation of law, and pay any resulting damages and reasonable costs.
17. Governing law and disputes
These Terms are governed by the laws of the State of Michigan, without regard to conflict of laws rules. Before filing a claim, each party agrees to try to resolve the dispute informally for 30 days after written notice. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Oakland County, Michigan, and both parties consent to their jurisdiction.
18. Changes to these Terms
We will notify you by email or in the Services at least 30 days before material changes take effect. If you keep using the Services after that, the updated Terms apply. If you do not agree, you can cancel before they take effect.
19. General
These Terms, our Privacy Policy and any order form are the entire agreement between you and OpenBeam about the Services. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. If any provision is unenforceable, the rest remains in effect. Failing to enforce a provision is not a waiver. Neither party is liable for delays caused by events beyond its reasonable control. We may send notices to the email on your account; you may send notices to the address below.
